1. Acceptance of Terms
By accessing or using smtpgo.com.au (“Service”, “Platform”, or “SMTPGO”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any applicable laws and regulations. If you do not agree, you must not use our Service.
2. Description of Service
SMTPGO provides a cloud-based email delivery service that allows users to send transactional and marketing emails through SMTP and API endpoints. The service includes DNS configuration tools, email analytics, domain verification, and user authentication.
3. Eligibility
- Be at least 18 years old
- Have the legal capacity to enter into a binding contract
- Provide accurate and up-to-date registration information
4. Account Registration & Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use
SMTPGO reserves the right to suspend or terminate accounts for any reason, including suspected abuse or violation of these Terms.
5. Acceptable Use Policy
You agree not to use SMTPGO for:
- Sending unsolicited bulk email (spam)
- Phishing, fraud, or impersonation
- Malicious content including viruses or malware
- Sending emails without domain ownership verification
- Any illegal or unauthorized purpose
We reserve the right to suspend accounts found violating our Acceptable Use Policy without notice.
6. Email Sending Limits and Reputation Management
SMTPGO may impose limits on:
- Daily or hourly email volumes
- Domain or IP warmup rates
- Bounce and spam complaint thresholds
We reserve the right to throttle, delay, or suspend delivery to protect deliverability and IP reputation.
7. Domain Verification & DNS Configuration
- You must complete verification using a DNS TXT or CNAME record
- You agree to maintain SPF, DKIM, and DMARC records as required
SMTPGO is not responsible for email failures due to incorrect DNS configuration.
8. Payment and Billing (if applicable)
- Fees are billed in advance and are non-refundable
- Failure to pay may result in account suspension
- Prices are subject to change with prior notice
- Taxes and applicable fees are the responsibility of the customer
9. Termination
You may cancel your account at any time. SMTPGO reserves the right to:
- Terminate or suspend your access at our sole discretion
- Delete your account and associated data upon termination
10. Service Availability and Support
We strive for high availability but do not guarantee:
- 100% uptime
- Immediate resolution of technical issues
You acknowledge that the Service may be unavailable during planned maintenance or unexpected outages.
11. Data Privacy
We collect and process data according to our Privacy Policy. You are responsible for:
- Ensuring your use of SMTPGO complies with applicable privacy laws (e.g., GDPR, Spam Act)
- Gaining proper consent from your recipients
12. Limitation of Liability
To the maximum extent permitted by law, SMTPGO shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of data, email delivery, or business interruption
Our total liability shall not exceed the fees paid in the previous 3 months.
13. Indemnification
You agree to indemnify and hold harmless SMTPGO, its owners, staff, and affiliates against any claims, damages, losses, or legal fees resulting from your use of the Service or violation of these Terms.
14. Modifications to Terms
We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms. We will notify users of material changes via email or platform notification.
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Western Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Perth, WA.
